Google’s New AI Terms: Your Business Needs Guardrails Now

October 22, 2026/in AI in Google Workspace, Blog, Cybersecurity, General

Audit Your Internal Policies to Prevent Service Termination

Written by Allen Falcon, Co-Founder & CEO, Cumulus Global

Effective October 12, 2026, Google made significant changes to their terms of service related to your use of AI. In addition to clarifying intellectual property rights, these changes create new responsibilities and legal obligations.

Violations of these new policies can result in immediate termination of your services.

Key Takeaways

  • ✓ You’re liable for all AI activity across your domain
  • ✓ Google can terminate your services immediately if you violate new terms of service
  • ✓ You need clear usage policies and guardrails to avoid liability and business disruption

Key Changes:

  • Google Cloud Terms of Service and Google Workspace Service Specific Terms (SST):
    • Changes to Sections 12 and 13 of the Google Workspace Service Specific Terms to clarify positions on intellectual property ownership and liability when interacting with different types of AI agents.
  • Google Cloud Agentic AI Responsible Use Guidelines:
    • These new guidelines supplement Google’s Acceptable Use Policy and Generative AI Prohibited Use Policy.
    • They provide guardrails, restrictions, and recommendations to help you mitigate emerging agentic risks, protect user privacy, and facilitate the safe deployment of AI agents as the technology continues to evolve.
  • Google Cloud Terms of Service:
    • Updates to Sections 3.3 and 13.2 of the online Google Cloud Terms of Service clarify that use restrictions apply to your AI agents and indemnify Google if your AI agents violate our Acceptable Use Policy.
    • Updates to Section 8.3 as of September 2, 2026, allow Google to terminate your agreement immediately if you breach the agreement in a manner Google determines is incapable of being cured.
  • Note: These changes will not impact any customers with offline agreements for Google Workspace.

What This Means For You

Google's New AI Terms

The Google Workspace Service Specific Terms now outline definite positions on intellectual property and corporate liability when your personnel create, use, or interact with AI agents. You retain ownership of your proprietary data and you are fully accountable for the prompts entered, actions, and the results.

When you build AI Agents or bots that interact with external clients, you guarantee that those tools follow established conduct policies. If an Agent produces harmful content, discloses or accesses restricted material, or acts maliciously, Google does not shield you from the fallout.

The Google Cloud Terms of Service reinforce this stance in Sections 3.3 and 13.2. These clauses specify that regular acceptable use restrictions apply directly to AI agents, which means you can’t bypass rules by delegating tasks to automated programs.

You indemnify Google for any violation of Google’s usage standards.

Google published the Google Cloud Agentic AI Responsible Use Guidelines to establish explicit behavioral expectations for autonomous software. These directives work right alongside the existing Acceptable Use Policy and Generative AI Prohibited Use Policy.

Under Section 8.3 of the Google Cloud Terms of Service, Google holds the authority to terminate your service agreement immediately if you violate the terms in a way that Google determines cannot be cured quickly or appropriately.

Severe infractions by AI Agents or your personnel can shut down your cloud environment without warning and sever access to shared communications or routine files.
